How can I regain possession of my property at the end of the tenancy?

 

Under the 1988 Housing Act as ammended, owner/occupiers are guaranteed the right to repossess the property at the end of the tenancy provided the correct procedures have been followed at the beginning and end of the tenancy. Two months notice is required to be given to the tenant.

The length of the tenancy will vary according to the requirements of the Landlord and Tenant and the type of tenancy agreement being used. The usual type of agreement is the Assured Shorthold Tenancy. This is normally for a minimum period of 6 months. In general tenants require a longer tenancy so we recommend an initial 6 month contract which can be renewed or a 12 month contract in most cases. We will draw up the Tenancy agreement and the relevant Notices for signing by both the Landlord and the Tenant. We will then collect the deposit and the first months rent from the Tenant.

A different form of tenancy agreement will be required; where the tenant is a company requiring the property for named employees, and when the property is of high value (currently over £2083 per month). Again provided the relevant rules and regulations are followed and the appropriate forms and notices signed you will regain possession of the property.
